Which party is  liable for the truck accident?

The NYC trucking industry is heavily regulated and is subject to state, federal laws, and local laws. Truck drivers and operators, trucking companies and others who are involved in the commercial trucking industry are also subject to certain standards. If any of the laws, standards, rules, and regulations are ignored or improperly implemented, one or more of these trucking entities may be liable for your accident involving a truck:

  • The driver: Did the truck driver operate the truck recklessly? Was he (or she) drugged or intoxicated, or was there a violation of the Federal Hours of Service rules?
  • The trucking company: Did they fail to follow regulations or have unreasonable deadlines?  Were their trucks improperly maintained?
  • The freight company: Did they improperly secure the cargo load or overload the truck?
  • The truck manufacturer or truck components manufacturer: Is there an inherent flaw in the manufacture or design of the truck  or any of it’s parts? Are the brakes, tires, lighting, computer, or other systems faulty?

Like all personal injury cases, determining liability in truck accident cases is a factor in getting you the best possible compensation for your serious physical and financial injuries, or those injuries relating to the wrongful death of a loved one.  Whether you were walking as a pedestrian, or in a motorcycle accident with a truck or drive a minivan, we will drive a hard bargain with the insurance companies either at the negotiating table or in the courtroom. Trucking Accident Common Causes

    Trucking Accident Causes

  •  Turning & Maneuvering:  Big trucks require a lot of room and clear views to turn and maneuver.  In NYC It is routine for truck drivers to cut across lanes and use more than one lane of traffic to make a right turn. These improper turns occasionally result in blind spot located passenger located vehicles being crushed or a pedestrian hit.
  • Fatigue:Despite Federal Laws limiting a truck drivers driving time, some truckers, due to trucking and shipping company time and monetary pressures,  still continue to disregard these driving limits by operating their trucks for long hours in order to keep up with the trucking company requirements.
  • Jack-knife:Larger 18-wheeler type trucks can jack-knife if they stop suddenly shifting their cargo load. This sudden cargo shift often causes the truck’s trailer to go around and often end up sideways.  When this scenario occurs, there is no safe place for passenger vehicles to go.
  • Drug & Other Stimulants:  Due to the long driving hours many truck drivers occasionally have been known to use stimulants to keep themselves awake, despite the fact that most of these stimulants are illegal.  As stimulants wear off, truck drivers usually begin to fatigue and tire rather quickly, causing them to fall asleep at the wheel.
  • Brake Time:Large trucks, due to their massive size and weight take a longer distance to stop then smaller vehicles which causes a large number of rear-end accidents or pedestrian accidents. Rear-end collisions from a truck generally have much more impact than with a smaller automobile, due to the weight of the truck requiring more stopping distance.

18-Wheeler Truck Accidents

  • Truck Tire Blow Outs – If tire treads on truck tires become old or defective, a tire blow out can occur.  A tire blow out sometimes results in the immediate loss of control of the truck, including when the back end of the truck begins to fishtail. When tire blowouts occur, the truck can go airborne or flip and in the process cause a rollover. Some tire blowouts can cause the truck to stop suddenly, which sometimes results in a car pile-up on the highway behind it.
  • Unsecured Cargo Loads – When loads or equipment are not properly secured on the truck’s trailer, they can shift and/or fall off the truck onto the highway.  This truck operator error can cause an obstacle course of debris for other vehicles.  When a truck operator changes highway lanes or turns the improperly secured load, the inside of the truck’s trailer can shift and cause the truck to lose control. The truck operator/driver, truck owner, and the trucks’ manufacturer can all be held responsible for putting innocent people in harm’s way.
  • Jack-Knife Accidents – A jack-knife truck accident can be catastrophic for all who come in contact with the truck, including the truck driver.  A jack-knife is when a truck with a tractor goes into a skid and the trailer swings out and stops to form a 90 degree angle. Jackknifing usually occurs when the drive wheels lock while the front wheels and the trailer keep rolling forward. A jack-knife can cause multi-car pile-ups, which often result in many fatalities.
